Welcome to Avazo. Below is our multi-vendor marketplace website policy for www.avazo.com. This policy is designed to be comprehensive and cover key areas of usage. This policy was adapted to fit the needs and legal requirements of our marketplace. By joining our marketplace, you agree to comply with the below terms and conditions:
Definitions
Terms of Service (“Terms”) govern your access to and use of the Avazo website, including any content, functionality, and services offered on or through www.avazo.com (the “Website”). By accessing or using the Website, you agree to be bound by the Terms.
Buyer Responsibilities
- You must be 18 years old or of legal age in each jurisdiction where you access the Website.
- By using the Website, you represent and guarantee that you have the legal capacity to consent to the Terms.
- Buyer is responsible for reviewing product descriptions and seller policies before making a purchase.
- Buyer must pay for products or services purchased on the Website.
- Buyer must comply with all return and refund policies.
- Buyer is responsible for providing accurate shipping information.
- Buyer must communicate with sellers in a respectful and professional manner.
Eligibility
- “Website” refers to Avazo and www.avazo.com. “User” or “You” refers to any individual or entity accessing or using the Website, including buyers and sellers.
- “Seller” refers to a user who lists and sells products or services on the Website.
- “Buyer” refers to a user who purchases products or services on the Website.
- “Content” refers to any text, graphics, images, audio, video, software, data compilations, and any other form of information capable of being stored in a computer that appears on or forms part of the Website.
Seller Responsibilities
- Sellers (vendors) must create an account, providing accurate, current, and complete information. Seller is responsible for maintaining the confidentiality of the account credentials.
- Sellers must verify their business credentials and provide valid tax identification numbers.
- All seller accounts are subject to verification. We reserve the right to refuse service to anyone for any reason.
- Sellers are responsible for the accuracy, legality, and safety of their product listings.
- Sellers must comply with all applicable laws and regulations, including those related to product safety, customs rules, intellectual property, and consumer protection.
- Sellers are responsible for setting their own prices, managing their inventory, and fulfilling orders.
- Sellers are responsible for customer service related to their products, including responding to inquiries and resolving disputes.
- Sellers must adhere to all shipping and return policies as set forth herein.
- Sellers are responsible for paying any applicable fees or commissions to the marketplace website.
- Sellers must provide accurate and complete product descriptions, including any necessary warnings or disclaimers, costs, estimated delivery times, and tracking information.
- Sellers are responsible for order fulfillment, customer service, inventory management, and compliance with applicable laws and regulations.
- Sellers must process orders within specified timeframes and provide tracking information when available. Clear policies cover shipping methods, delivery timeframes, damaged goods, and return procedures. Dispute resolution processes are established for order-related issues.
Products Listings
- All products must comply with local, state, federal, and international laws, including safety standards and import/export regulations.
- Accurate Descriptions: All product listings must have accurate descriptions, clear images, pricing, delivery expected time and availability status.
- Prohibited items include illegal goods, counterfeit products, hazardous materials, and items that violate intellectual property rights. Product images and descriptions must be accurate and not misleading.
- Pricing: Sellers set their own prices. Pricing must not include hidden fees or charges.
- Payment Processing: All payments will be processed through Avazo’s merchant account, and vendors will receive payment as per the agreed schedule.
Prohibited Activities
- Listing or selling illegal or prohibited items.
- Engaging in fraudulent or deceptive practices.
- Violating the intellectual property rights of others.
- Using the Website for any unlawful purpose.
- Harassing, threatening, or abusing other users.
- Uploading or transmitting viruses or other malicious code.
- Attempting to gain unauthorized access to the Website or its systems.
- Spamming or engaging in unsolicited advertising.
Fees and Payments
- Commission fees for the sold items are 7.5% (Including credit cards processing fees).
- Buyers are responsible for paying for products or services through the Website’s designated payment methods.
- Payments to sellers will be processed 72 hours after the buyer confirms the order received.
- After 01.01.2026, Avazo may charge sellers fees or commissions for listing and selling products on the Website. The fee structure will be clearly outlined in the seller agreement updates.
Shipping and Returns
- Shipping Responsibility: Sellers are responsible for shipping their products promptly and safely.
- Sellers are responsible for setting their own shipping policies with expected delivery time.
- Buyers and sellers must accept the return and refund policies set forth by Avazo (https://www.avazo.com/return-and-refund/).
- Avazo is not responsible for lost or damaged shipments.
- Return order fees have to offset the cost associated with processing returns, including reverse logistics, inspection, and potentially restocking or refurbishing the returned goods.
Intellectual Property
- Users agree not to infringe on any copyrights, trademarks, or patents or other sellers. The website provides mechanisms for reporting intellectual property violations and follows DMCA takedown procedures. Vendors warrant they have rights to sell all listed products.
- Users may not use the Website’s content for commercial purposes without the express written consent of Avazo.
- Avazo Sellers retain ownership of the intellectual property rights in their product listings, but grant Avazo a license to use their listings for promotional purposes.
Disclaimer of Warranties
- The Website is provided “as is” and “as available” without any warranties of any kind, either express or implied.
- Avazo does not guarantee that the Website will be error-free or uninterrupted.
- Avazo does not endorse or guarantee the quality, safety, or legality of products or services listed on the Website.
Limitation of Liability
- The Avazo marketplace acts as an intermediary and disclaims liability for vendor actions, product quality, or transaction disputes. Users acknowledge risks associated with online transactions and agree to resolve disputes primarily with individual vendors.
- Avazo shall not be liable for any damage arising out of or in connection with the use of the Website.
- Avazo’s liability to users shall be limited to the amount of fees paid by the user to Avazo in the past 3 months.
Termination
- You agree to indemnify and hold harmless Avazo from any claims, losses, damages, liabilities, costs, and expenses (including attorneys’ fees) arising out of or in connection with your use of the Website or your violation of these Terms.
Changes to Terms
- These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania.
- Avazo reserves the right to unilaterally modify the Terms, as necessary to comply with rules and regulations of intrastate, interstate and international commerce or for any reason. Notice regarding change in Terms will be provided to all users 30 days prior to implementation.
- Your continued use of the Website after any changes to the Terms constitutes your acceptance of the new Terms.
Governing Law
- Avazo may terminate your access to the Website at any time for any reason, including your violation of these Terms.
